Intermediation of holiday homes in Spain

Angel Holidays GbR (AH) operator of the website Angel Holidays is offering customer services as intermediator of holidays due basis of these general terms and conditions. These general terms and conditions regulates the legal relationship of the operator of this website as intermediator and the customer. AH (Angel Holidays GbR) is offering touristy individual performances. With submission of the application form by the customer to AH will be concluded an agreement contract for valuable consideration. AH is exclusively acting as intermediator between the customer and the property owner and is acting on behalf of and for account of the property owner or the landlord of the property. All existing links to offers of third parties are not represented as broker or intermediator by the operator (AH) of this website.

1. Contract of intermediation :
   1. AH is submitting a binding offer to conclude a contract of intermediation. The offer can happen in written form, by phone or online (application form). The applicant (customer) is placing the order of intermedation to AH by sending the application form. It is concluded a contract of mediating the reservation between the operator Angel Holidays GbR and the customer.
   2. After the final confirmation of the property owner, the customer receives a written confirmation of the intermediation to his email address. Four weeks before the arrival the customer will receive the meeting point informations of the property owner.
   3. The services of AH as intermediator ends with submission of the meeting point documents to the customer. The contract of intermedation is just valid for the confirmed quantity of people. With submission of the intermediation contract the customer (applicant) concludes a verbal rental contract with the property owner.
2. Payment
   1. With the arrangement of the intermediation contract a deposit is payable after booking. The payment method of the rest amount is depending on the offered property. The amounts of the deposit and the remaining amount are confirmed in the application form and in the confirmation of the intermediation contract. The final payment has to be made to the property owner of landlord of the property. The agency fee is included in the offered price and is paid to the operator of this website in the deposit.
   2. The customer is asked to use the indicated IBAN and SWIFT bank account details, so the banking charges for the payment are very low. The agency does not bear the bank transfer charges of the customer for incoming payments from foreign countries.
   3. For each changement of the intermedation contract on behalf of the customer, it will be charged a administration fee. The amount fo the fee depends on the offer. IIn case of delayed or incomplete payment the contract of intermedation can be deleted subjected to a charge.
3. Cancellation of the contract
   1. There are effective the cancellation charges of each property owner. The cancellation fees are confirmed in the application form and can be checked in each offered property on the website under prices “cancellation fee”.
4. Services
   1. The offered services of this website are exclusive intermediation services of external services between the applicant (customer), the fellow travelers and the property owner. The contract is concluded on behalf of and for account of the property owner or the landlord of the property and is valid for the confirmed quantity of people and the indicated period.
   2. The customer (applicant) concludes a verbal rental contract with the property owner. The service of AH is ending with the submission of all documents.
   3. The applicant (customer) is concluding a intermediation contract (agency agreement) subject to german law §§ 675, 631ff BGB.
5. Liability
   1. Each offer is issued according to the informations provided by the property owner of landord of the property. The operator of Angel Holidays does not assume liability for the correctness of these specifications. Specifications like distances to the sea, to the airport, to the center, etcetera are just estimated specifications and are treated as estimated specifications.
   2. The operator of this website Angel Holidays GbR is taking over the responsibility to realize a proper transaction of the intermedation contract (agency agreement) subject to german law §§ 675, 631ff BGB. This includes the forwarding of all necessary informations between the customer (as tenant) and the property owner (as landlord) to enable a correct fulfillment of the service provision on the part of the landlord.
   3. It exists non-liability for influences caused by acts of God, war, strikes, electricity failure, blackout of supply water and storm, which could annoy the rental properties. If the rental property can not be used due to acts of God and if there is no alternative property available, the liability is limited to the paid amount by the customer.
   4. The operator of the website (AH) is not responsable for deficiencies of the service, failures, disturbances, personal damage or material damage in combination of services, which are just intermediated as external service.
6. Responsability of cooperation
   1. The customer is obliged to check the inventary and to communicate conspicuousness, defects or deviances within 24 hours after arrival to the landlord or houseowner or the responsable contact person.
7. Travel insurance
   1. It will be recommended a travel insurance.
8. Arrival/Departure
   1. Check-in is possible at 16.00 pm, check-out is till 10.00 am.
9. Jurisdiction
   1. Concerning all claiming compensations the customer has to contact the responsible property owner. Place of execution and jurisdiction is the place of the property, respectively the domicile of the property owner.
10. General
    1. It is drawn attention to the fact that the customary style of furnishing, respectively the mallorquin or menorquin style is different from the middle-european style.
11. Salvatory Clause
    1. Should any part of this agreement be invalid for any reason, it is to be replaced with a corresponding text, which is valid and equivalent to the intended meaning. The rest of the agreement shall remain unaffected and valid.
